Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Vibe Vote (“Vibe Vote,” “we,” “us”) governing your use of our website, editor extensions and command-line integrations, and backend services (together, the “Service”). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be old enough to form a binding contract in your jurisdiction, and at least the minimum age required for data processing where you live (at least 13, and 16 where required). If you use the Service for an organization, you represent that you are authorized to accept these Terms on its behalf.
2. The Service
Vibe Vote is a game you play while your AI coding agent is working. It shows quick would-you-rather questions, lets you vote on them, and shows aggregate results. It is free to play. We may add, change, or remove features, and we may set or change limits, at any time.
3. Accounts and identity
You can play anonymously or sign in with Google. You are responsible for activity under your account and for keeping access to it secure. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or abusive.
4. License and intellectual property
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. We and our licensors retain all rights in the Service, including software, content, question banks, trademarks, and design. You may not copy, modify, distribute, sell, or create derivative works from the Service except as permitted by law or by us in writing.
5. Acceptable use
You agree not to:
- automate, script, simulate, or otherwise manufacture votes, predictions, accounts, or activity, or otherwise manipulate scores, streaks, results, or any future earnings;
- reverse engineer, decompile, scrape, or attempt to extract source code or data except to the extent the law permits this and cannot be waived;
- interfere with, overload, or disrupt the Service, its security, or its anti-abuse measures, or attempt to access data that is not yours;
- use the Service to violate any law or third-party right, or to submit content that is unlawful, infringing, harmful, harassing, hateful, or that targets or exposes a real person;
- use the Service in a way that interferes with your AI agent's prompts or that you know could cause unintended commands to run.
6. User submissions
If we enable user-submitted questions or other content, you keep ownership of what you submit and grant us a worldwide, royalty-free, sublicensable license to host, store, reproduce, modify for formatting, display, and distribute it within the Service. You represent that you have the rights to submit it and that it does not violate Section 5. We may screen, moderate, refuse, label, remove, or restrict submissions at our discretion, and we keep an audit record of moderation decisions. Submissions may be served subject to fail-closed moderation: content is not shown until it clears review.
7. Third-party tools and no affiliation
Vibe Vote works alongside tools such as Claude Code, Codex, Cursor, and other editors and agents. Vibe Vote is independent and is not affiliated with, endorsed by, or sponsored by Anthropic, OpenAI, Microsoft, Cursor, or any other provider. References to those products are nominative only. The Service observes whether your agent is busy and renders in its own surface; it does not access your model traffic, prompts, source code, API keys, tokens, or subscription. Your use of those third-party tools is governed by their own terms.
8. Sponsored content
Some questions may be sponsored. We label sponsored questions clearly. Sponsored content does not change how your votes are recorded or how aggregate results are computed.
9. Future paid voting and earnings
Paid voting is not live yet. If and when we launch it, earnings are a per-vote rate that accrues to a balance and pays out only above a minimum threshold, and only for votes that pass our anti-fraud and verification checks. Payouts require identity verification and acceptance of separate payout terms, and may be subject to tax reporting. We may withhold or reverse amounts associated with fraud, automation, or violations of these Terms. Any founder or early-adopter rate we describe is a genuine, ongoing commitment on the terms we state at the time, subject to the anti-fraud and verification requirements.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that results or scores are accurate.
11. Limitation of liability
To the fullest extent permitted by law, Vibe Vote and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or earnings, arising from or related to the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold Vibe Vote harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or to protect the Service. Sections that by their nature should survive termination will survive, including license, disclaimers, limitation of liability, indemnification, and governing law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least thirty days. Any dispute that is not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Texas, and you consent to that jurisdiction and venue, except where applicable law gives you the right to use a different forum. Nothing here limits rights you have under the mandatory laws of your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. We will revise the date above and, for material changes, provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
16. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
